FULL TERMS AND CONDITIONS OF MOTORCYCLE HIRE

The following terms and conditions of RoadCraft Europe Ltd. (the "Company") and will apply to any individual (the "Hirer") who signs a hire agreement (the "Rental Agreement") leasing a motorcycle (the "Motorcycle") from the Company:

    General Conditions

  1. The Company agrees to rent the Motorcycle to the Hirer and the Hirer agrees to accept the motorcycle for rent from the Company. The Hirer acknowledges that the motorcycle to be rented is fit for his/her purpose. The Hirer confirms that he/she has been given adequate time and opportunity to carefully read the terms and conditions contained herein and agrees to be bound by them in their entirety.

  2. The Motorcycle is the property of the Company. The Hirer agrees to return the motorcycle together with all the tyres, tools, accessories and other equipment in the same condition as received at commencement of this Rental Agreement to the place and on the date and time specified overleaf, or sooner if demanded by the Company.

  3. The Hirer shall receive orientation to the motorcycle. The orientation shall in cover all aspect of safe motorcycle operation and the Hirer’s maintenance responsibilities in respect of the Motorcycle.

  4. During the rental period the Hirer shall keep the motorcycle together with its accessories, tools and equipment in his/her sole possession and free from any and all legal process or lien and when not in use to adequately protect and secure it.

  5. The Company reserves the right to substitute the motorcycle to be rented to the Hirer. Should the Company not be able to provide the confirmed motorcycle on the day of the rental, a suitable alternative motorcycle will be provided. If another motorcycle is not available, the Company will reimburse the Hirer the rental fee as applicable. The Company will make reasonable efforts to accommodate any requests for specific motorcycles.

  6. The Trainee accepts that riding a motorcycle can be hazardous and that it is recommended that he/she always wear full protective clothing, including jackets, trousers, boots, gloves as doing so may reduce the seriousness of certain types of injury in the event of certain types of accident.

  7. Commencement Date

  8. The Hirer may use the vehicle for the period shown in the Rental Agreement. The Company may agree to the rental period, but only by prior arrangement. If the Hirer does not return the Motorcycle at the specified time, the Hirer will be charged for late return of the Motorcycle at the standard daily rate.

  9. At the end of the rental agreement, the Hirer must bring the Motorcycle back to the specified location. A member of staff must inspect the Motorcycle before your responsibilities can end. If for any reason the Motorcycle is returned outside of our business hours, the Hirer will remain responsible for it until a member of our staff inspects it.

  10. Rent

  11. The Hirer expressly acknowledges personal liability to pay Company on demand:

    1. the Rental due under the Rental Agreement
    2. any additional rates specified in the Rental Agreement
    3. any fines, charges and court costs for parking, speeding or any other offence committed during the rental period, including any administration charges arising therefrom
    4. the Company’s costs, including reasonable legal fees incurred in collecting payments due from the Hirer and
    5. compensation for the Company’s loss of use of the Motorcycle whilst being recovered at the termination of the rental period whilst being repaired consequent upon any collision of other damage suffered before the motorcycle was returned to the Company’s place of business.

  12. The Hirer shall be liable as owner of the Motorcycle in respect of:

    1. any fixed penalty offence committed in respect of that motorcycle under Part 111 of the Road Traffic Offenders Act 1978 (as amended by the Parking Act 1989 and further amended, modified or replaced from time to time); and
    2. any excess charge incurred relating to the Motorcycle in pursuance of an order under Sections 45 and 46 of the Road Traffic Act 1984 (as amended by the Road Traffic offenders Act 1988 and by the Parking Act 1989 and furtheramended, modified or replaced from time to time); and
    3. any financial penalty or charge which may be demanded by any individual or entity or authority as a result of the Motorcycle being parked improperly.

    Use of Motorcycle

  13. The motorcycle will not be used for any of the following purposes:

    1. by any person not holding a valid current licence including where necessary or appropriate a CBT Pass Certificate;
    2. by any person other than the Hirer who has signed the Rental Agreement;
    3. by any person who has been convicted of any UT, DR, DD, MS, CD or three or more other driving offences;
    4. by any person who has within the preceding period of five years been convicted of any BA, XX99 or TT99 offences;
    5. for any unlawful purpose or in contravention of any Act, Order Regulation affecting the motorcycle;
    6. for use outside England, Scotland or Wales without the Company’s prior written consent;
    7. for the carriage of passengers for hire or reward;
    8. to propel or tow any other motorcycle or trailer;
    9. for racing, pacemaking, reliability trials or speed testing;
    10. to carry greater number of passengers (if applicable) and/or more baggage than recommended by the manufacturer of the Motorcycle;
    11. by any person under 17 years of age;
    12. in any manner which may render the applicable insurance policy void;
    13. to ride the Motorcycle on any track or off-road;
    14. to sell, rent, lend or dispose of the Motorcycle or any part thereof; or
    15. for fast food delivery.

    Maintenance of Motorcycle

  14. Throughout the period described in the Rental Agreement, the Hirer must look after the Motorcycle, its keys and all extras rented with the Motorcycle (including, without limitation, any accessories such as helmets, gloves, jackets, locks, etc.). The Hirer shall lock the Motorcycle and where possible, keep it in a locked garage.

  15. The Hirer must protect the Motorcycle from any damage, howsoever caused. The Hirer must ensure the correct fuel and that tyre pressures, engine oil and water levels are correctly maintained. The Hirer will be held responsible for mechanical damage (including, without limitation, tyre punctures, burnt out clutch, etc.) due to negligence in motorcycle use or failure to provide normal maintenance.

  16. The Motorcycle must remain roadworthy at all times.

  17. The Hirer is responsible for all damage to the vehicle which is not otherwise covered by insurance.

  18. The Hirer shall not perform nor shall the Hirer cause anyone perform any work on the Motorcycle without express prior consent from the Company.

  19. If you become aware of a fault with the Motorcycle, the Hirer must inform the Company immediately as the fault becomes known to the Hirer.

  20. The Company is not and cannot be held liable for loss or damage to any property stored, transported in or on the Motorcycle.

  21. Security Deposits

  22. A security deposit of £ 350.00 will be taken at the time of pick-up. The security deposit will be returned when the bike is returned and after the Company determines that no additional charges are due.

  23. Reservation fee

  24. A fee of £ 30.00 is due when reserving a bike. This will be offset against the security deposit when collecting the motorcycle.

  25. Cancellation

  26. If the reservation is cancelled for any reason whatsoever (including any change to the date of reservation) then the Hirer will forfeit his/her reservation fee

  27. Fuel

  28. Fuel costs are the Hirer’s responsibility. The Company claims no responsibility for motorcycle fuel consumption and mileage.

  29. All motorcycles operate on regular/super unleaded fuel.

  30. On the date of hire, the Motorcycle will be supplied with a full tank and must be returned with a full tank. If the Motorcycle is returned without a full tank of fuel prior to returning the Motorcycle, please note that the Hirer will be charged £ 15.00 as an additional charge, regardless of the amount of fuel left remaining in the tank.

  31. Driver’s Licence & Identification documents

  32. The Hirer must present a valid UK driving licence at the time of rental for any Motorcycle. Customers holding the new Photocard Driving Licence must remember that the photocard and paper counterpart make up the complete driving licence and both must be produced when renting a Motorcycle. If the hirer does not hold the new Photocard Licence then a passport will be required with the paper counterpart.

  33. The Hirer must also present two other forms of identification from the following list:

    1. Any major credit card;
    2. cheque book;
    3. debit / cheque guarantee card;
    4. passport (only for those with a new Photocard Driving Licence),
    5. current bank statement (not more than 1 month old); or
    6. public utility bill (gas, electric, telephone - not more than 3 months old).

  34. For driver’s licences containing codes DD (Reckless Driving), DR (Drink or Drugs), UT (Theft or unauthorised taking) and disqualifications of 12 months or more, the riders disqualified are allowed to rent only five years after the date of endorsement expiry. Short term disqualifications of less than 12 months, i.e. speeding or accumulation of points, allow the disqualified drivers to rent from the date of endorsement expiry.

  35. Insurance

  36. The motorcycle is, at all times covered by the Company’s insurance policy, the terms of which are available for inspection by the Hirer in the Company’s office. The Hirer shall, however remain liable for any loss or damage to the Motorcycle as a result of the wilful act or negligence of the Hirer, his agent(s) or servant(s) or any breach of the terms of the insurance policy and shall indemnify the Company from any third party claim, whether consequential or otherwise which arises therefrom.

  37. Riding Offences and Accidents

  38. In the event that a traffic offence (the "Offence") is committed by a Hirer while under the rental period, the Hirer shall be responsible for any charges, fees or penalties as a result thereunder. The Company is hereby authorised to seek immediate reimbursement for such either by payment from the Hirer’s credit card or otherwise, after such Offence has been committed. The Company may forward the Hirer’s personal details to the relevant authorities if required by law.

  39. The Hirer agrees to protect the interest of the Company and the Company’s insurer’s in the case of an accident during the term of this the Rental Agreement and shall immediately report to the Company any accident in which the Motorcycle is involved and shall:

    1. make every endeavour to obtain the names, addresses and registration numbers including motorcycle details of all parties involved;
    2. obtain names and address of witness;
    3. not admit liability or guilt;
    4. notify police immediately if another party’s guilt has to be ascertained and/or people are injured;
    5. not abandon or leave the motorcycle unattended without first ensuring adequate provision for safeguarding and securing it; and
    6. provide the Company with a detailed written report including a diagram on detailing the particulars of the accident.

    Data Protection Act 1964

  40. The Company and Hireguard use a national database in conjunction with insurers to aid avoidance of:

    1. fraud;
    2. multiple claims;
    3. bogus hirers; and
    4. to monitor hirers drivers performance.

    In compliance with the Data Protection Act, Hireguard is the data user and is accordingly licensed by the data protection Registrar. Registration Number N 0802 121.
