The following are terms and conditions of RoadCraft Europe Ltd. (the "Company") and will apply to all individuals undertaking motorcycle training (the "Trainees"):
- Click to see Terms / Documents Required when booking a CBT course.
- The Company shall provide an Instructor to the Trainee for the sole purpose of providing tuition according to the terms of the contract.
- The Company shall have the right to substitute another Instructor at any time for any reason whatsoever. In the event that an Instructor is not available due to unforeseeable circumstances, the Company will make reasonable efforts to inform the Trainee as soon as possible and will refund the training fees and/or exam fees for that day and reschedule for training and/or exam at the next mutually agreeable time.
- The Company cannot guarantee that a Trainee will be provided with the requested motorcycle during a training session. The Company will make reasonable efforts to accommodate any requests for specific motorcycles.
- The Instructor reserves the right to cancel or rearrange a lesson due to unsafe weather conditions. The determination of whether weather conditions are unsafe will be made in the sole discretion of the Instructor.
- The Company will carry motor insurance covering the Trainee whilst riding the training motorcycle, or being carried on the motorcycle whilst under the supervision of (i) an Instructor or (ii) a Driving Standards Agency Examiner.
- Course fees are payable in full in advance of the first lesson. The fees / deposit for each lesson will be lost if the Trainee cannot attend that particular lesson. It is not possible to alter training dates once set.
- The Company will supply the training motorcycle and safety equipment. In the event that a Trainee chooses to use their own machine for training purposes, it must be (i) in roadworthy condition and comply with all current regulations and legislation, including a display of the current regulation “L” plates and (ii) insured for the intended purpose of training. The Company reserves the right to refuse to train a Trainee on their own machine if the Instructor, in his/her sole discretion, deems the machine to be unsuitable for training purposes. NOTE: The Company strongly advises against using a Trainee’s own motorcycle with the exception of new bike acclimatisation courses or where the Company is unable to provide a specific motorcycle scooter or moped for training purposes.
- The Company will provide each Trainee with a safety helmet and other necessary protective equipment. If a Trainee chooses to use his or her own equipment, it must comply with all current applicable safety regulations. The Company reserves the right to refuse to provide training if the Instructor deems such Trainee’s own equipment to be unsafe or non-compliant with current legislation.
- The Company accepts no responsibility for any loss or damage, for any reason, to a Trainee’s personal property (including, without limitation, a Trainee’s own motorcycle).
- In the event that a traffic offence (the “Offence”) is committed by a Trainee while under instruction, the Trainee shall be responsible for any charges, fees or penalties as a result thereunder; the Company is hereby authorised to seek immediate reimbursement for such either by payment from the Trainee’s credit card or otherewise, no later than five (5) working days after such Offence has been committed. The Company may forward the Trainee’s personal details to the relevant authorities if required by law.
- The Instructor has the right to halt or suspend training of a Trainee if the Instructor, in his/her sole discretion, has reason to believe that the Trainee is under the influence of either drugs or alcohol.
- The Theory and Practical Test Fees will be forfeited by the Trainee under the following circumstances:
- Failure by the Trainee to attend a test for any reason;
- Failure by the Trainee to complete the recommended course (including the failure to successfully pass the Motorcycle Theory Test) prior to the Practical Test;
- Failure by the Trainee to present the necessary documentation at the time of either test; or
- Any action by the Trainee immediately prior to Trainee’s Practical Test which renders the Trainee’s motorcycle inoperable at the Practical Test (including any action which causes the motorcycle to no longer comply with Driving Standard Agency regulations and therefore is rendered an invalid motorcycle for purposes of Trainee taking the Practical Test).
- The Instructor retains the right to withdraw the Trainee from the intended Practical Test if the Instructor believes that the required standards of safety and control will not or have not been achieved. The Instructor may make reasonable efforts to enable the Trainee to take a test on a smaller capacity motorcycle.
- Fees for all training courses are non-refundable once the training sessions begin, including if a student is required to leave early, whether upon demand by the instructor or otherwise.
- In the event a student is unable to reach the prescribed standard for a CBT course, no certificate shall be issued and the student may decide to return at a later date for further training. A charge for the bike hire and insurance will apply if the Company’s vehicle will be used for the training.
- A valid provisional or full license for the respective motorcycle must be made available to the Instructor at all times during the course of the training. If a license is found to be invalid, the Trainee will forfeit all or part of the training.
- All equipment loaned free of charge to the Trainee must be treated with care and respect. If damage or loss is caused by neglect or misuse then the Trainee will be responsible to pay for the replacement of such equipment.
- The Trainee accepts that riding a motorcycle can be hazardous and that it is recommended that he/she always wear full protective clothing, including jackets, trousers, boots, gloves as doing so may reduce the seriousness of certain types of injury in the event of certain types of accident. The Trainee understands and accepts that all this equipment may not be supplied by the Company and the Trainee accepts full responsibility for the degree of protection he/she wishes to have.
- Payments for services of the Company may be made only in person at the Company’s offices or via the central booking office at 0845 1080 764.
